These "Auction Terms" govern use of Linkin Park Underground's auction services (the "Auction Services" or "Auction"). By bidding in an LPU Auction, you expressly agree to be bound by these Auction Terms, as well as the LPU Terms and Conditions, the LPU Privacy Policy, and the auction rules for the Auction, all of which are incorporated into these Auction Terms by this reference. Please check the site periodically to see if any such changes have been made.
NOTE: You must be a current LPU member in order to participate in the LP Underground auctions. If you are not a member and would like to bid, join the LPU HERE. If you are not a member and place a bid you run the risk of not having your bid count so please ensure your membership is current.
If you are under the age of 18 and wish to bid in the auctions you must have parental consent to register and bid. Please have your parent or guardian send an email to lpuauctions@lpunderground.com to verify your name, age and that you have permission to register and bid on the LP Underground Auctions site. Please include the word "Auction" in your subject line.
By using these services, you (or your parent or guardian) hereby warrant and represent that you are legally able to enter into and form a binding contract. To register, you must be able to provide your real name, address, phone number and email address, along with other information that may be required from time to time.

Auction Definitions
Lot – An item available for bidding in an auction
Lot Detail Page – The webpage where the lot bidding takes place
"Max Bids" (Up To, Ceiling or Limit Bids)
"Max Bids" (sometimes called UP TO, CEILING or LIMIT BIDS) are an option. When placing this type of bid you are instructing LPU to competitively bid on your behalf up to, but not over, a given amount/limit. Such bids must be calculated in the appropriate increments for the lot based on its current bid price. The website automatically displays these increments for you. Please note that the "Up To” bid increments that will appear for a lot will skip an increment to prevent a bidder from occupying two consecutive bids. For example, if a bid is placed of $100, the first available "Up To” bid will be $120, skipping $110, as an increment must be left available for another bidder to enter his bid. The bidding system will automatically execute "Up To” bids within seconds after a bid with an "Up To” has been topped. Remember, all bids must comply with the minimum bid raise rule.
"Straight" Bids
Bidders may place a “Straight” or “Absolute” bid on a lot. A “Straight” bid is defined as a bid placed at a level higher than the current next incremental bid. All straight bids must be placed in appropriate increments for the specific lots they apply to. In the event of tie bids, the earlier received bid will be the winning bid. This is especially significant with reference to “Straight” bids because if a "Straight" bid is placed at a higher than normal incremental increase on a lot on which another bidder has left an “Up To” bid, such “Up To” bid will have priority. For example, if a lot is bid at $100 by Bidder A with an “Up To” of $120, and Bidder B attempts to top the current high bid of $100 with a “Straight” bid of $120, then Bidder A’s “Up To” will automatically be executed and Bidder A will be the high bid at $120. Bidder B will be informed that he is not the high bidder at $120, and that the next bidding increment is $130. In this way, the bidding process can accommodate bidders wishing to place “Straight” bids while not compromising the bidding strategies of “Up To” bidders.
Additional Costs:
There are incremental costs of shipping your LP item to you that is not part of the final winning bid price. For example, should you win a lot for $1,000, your actual cost will be $1,000 plus taxes, and shipping to your location. Shipping costs will change depending on your location and country. We will coordinate with you to pick the best shipping option that contains tracking and is affordable (Fed EX, UPS or USPS). If you live outside of the U.S. additional customs clearance costs or duties may apply. Shipping costs cannot be confirmed until you have won the item and we have your exact location.
A Word About Starting Bids:
LPU believes a good auction features quality products and reasonable starting bids. The minimum bids in our auctions are priced fairly for members and the currency is in U.S. Dollars. The purpose of the minimums, in all LPU Auctions, is simply to set a standard price and allow the LPU community decide the true value of the item. You warrant that your credit/debit card or PayPal account has sufficient funds to cover any bid.
Bidding Times:
All LP Underground auctions start and closing times are based on Pacific Time zone. If you are the only bidder on a given lot at time of closing then that lot is automatically closed out and you are declared the winner.
Payment Of Invoices:
Auctions of Physical Goods
Within one week following the auction invoices will be sent to winning bidders by e-mail. Please do not call or email the LPU office regarding invoices prior to this date. Please remember that all invoices must be paid within one week of the invoice date. It is very important to pay promptly to ensure you receive your items shortly after the auction. We do not accept personal checks, cashier’s checks, certified checks, money orders, wire transfers or cash. Payments can be made through Credit Card or PayPal. After payment is received and confirmed by LPU it generally take 5-7 business days before shipment will occur. In the event you are unable to pay the invoice within one week we reserve the right to select the second highest bidder as the new winner. LPU thanks you in advance for your cooperation.
Auctions of Experiences
On occasion, LPU Auctions will have an opportunity to put an experience up for bidding. This may be based around tour dates or special events. The timing of both the invoice delivery and payment may be shortened. This is to ensure that the winning bidder does not miss the opportunity to take part in the experience. Any details based on experiences will be clearly communicated in the auction details.

Refunds/Returns
Returns and refunds of auctioned items will not be accepted.
Terms and Conditions of Sale
1. Lots are sold to the highest bidder.
2. For all Internet auctions, you must place an initial bid on a lot before closing day to be eligible to win the item.
3. All bidders must register to obtain an account before bidding. We encourage you to register early and please allow 24 - 48 hours for the system to approve your registration request. Once you obtain a Username and Password, these will be your Username and Password for all future LPU Auctions, unless you change them. 4. Access to bid is subject to membership with the LPU so make sure you have joined in advance of the auction you would like to bid in. Absolutely no registration will take place the day the auction ends (see #3 above) and no exceptions can be made. We reserve the right in our sole discretion to refuse to register a bidder or to refuse to accept bids from anyone. If you violate these Auction Terms or, in the sole discretion of LPU, LPU suspects you intend to violate these Auction Terms, LPU may terminate your use of the site, bar you from future use of the site, cancel your bids, terminate or refuse to allow your participation in any Auction, or take appropriate legal action against you. An order or bid may be rejected, cancelled or disqualified, or may otherwise not be accepted, by LPU if LPU determines in LPU's sole discretion that LPU has not received sufficient approval, authorization or verification of a bidder's billing address or credit (or debit) card or that a bidder has not complied with these Auction Terms, LPU's other agreements or policies, or any other auction rules. Such a rejection, cancellation or disqualification may occur either during an Auction or after the closing of an Auction. Consequently, if your bid is disqualified you may not win the items through an Auction even if your bid is high enough to have won.
5. You agree not to bid in an Auction through the use of more than one LPU Account. It is violation of these Auction Terms for one of more persons to submit, or facilitate the submission of, more than one bid using the same name, account, email address or credit card or to encourage others to bid on your behalf or to bid on behalf of another person.
6. To outbid, you must bid at least the next highest bid amount that is shown on the web site. All valid bid increments are displayed on the site using the values shown in the table below. There are absolutely no exceptions to the raise amounts. Placing a bid constitutes acceptance of the terms of sale outlined on this page. Current (real-time) bid status is available on our website with all lot listings and on the price grid.

During Live Auctions, bid increments over $20,000 will be at the discretion of LPU Auctions.
7. Subject to exceptions relating to credit considerations, all qualified bidders in good standing are eligible to bid on any lot in the auction. LP Underground and Machine Shop Marketing as Companies, as well as all of its employees (including executives and principals), are ineligible to bid in our auctions. Only LPUX Annual members are allowed to bid on auctions.
8. Offers to "top all other bids” are not accepted, but you may place a "Max” bid (also known as "Up To,” "Ceiling,” or "Limit” bid) and the system will automatically bid on your behalf up to that amount only if and when necessary. In the event of a tie bid, the earlier received bid will be recognized as the successful bid. (See Max Bids section of the Guide for Prospective Bidders, which follows these rules).
9. All Linkin Park material is guaranteed genuine; we offer no reproductions.
10. Please remember there are incremental costs of shipping your LP item to you that is not part of the final winning bid price. For example, should you win a lot for $1,000, your actual cost will be $1,000 plus taxes, and shipping to your location. Shipping costs will change depending on your location and country. If you live outside of the U.S. additional customs clearance costs or duties may apply.
11. No retractions of bids are permitted. Once a bid has been placed, it may not be retracted.
12. All sales are final and no returns are accepted. In the case of a bid in which the payment is deemed fraudulent LPU auctions has no obligation to deliver the ownership of the lot to the winning bidder. If we are notified of an issue of fraudulent payment we will contact the winner and notify them that they are not eligible to recieve the lot. In this instance LPU auctions may, at it's sold discretion, extend an offer of the given item(s) in the lot(s) to the next highest bidder. The original winning bidder is responsible for any losses incurred or service charges involved in the sale of said item(s), and that the non-paying winning bidder explicitly agrees to pay any and all reasonable legal fees incurred by LPU in the collection of these losses and/or service charges from the non-paying winning bidder if necessary.
13. In no event will LPU’s liability to a purchaser exceed the purchase price actually paid for any item. LPU Auctions reserves the right to accept or reject any or all bids by any bidder. LPU reserves the right to postpone or delay the auction, for a reasonable period of time, due to any significant, relevant event which, in the sole discretion of the auctioneer, makes it inadvisable to hold the auction as scheduled, without recourse from any bidder or prospective bidder.
14. Title to any lot remains with LPU Auctions and shall not pass to the successful bidder until the lot is actually paid for in full.
15. Payment is due within 7 days of the date of the invoice. We accept credit cards and PayPal, and it can take an additional 5-7 business days after funds have been collected before shipment occurs.
16. Placing a bid constitutes express acceptance of all terms and provisions contained in these Conditions of Sale. In the event of a dispute, the bidder agrees to pay all of LPU Auctions reasonable attorney’s fees and cost involved in collection of funds, plus 1.5% interest per month on any unpaid balance, accruing from the original due date, until the date all balances are paid. The jurisdiction for all litigation shall be in the State of California, County of Los Angeles or the Federal District Court of California at the discretion of LPU Auctions. Bidder hereby consents to the jurisdiction of California. Each term and provision of these Conditions of Sale shall be construed as separate and distinct. In the event that any such term or provision shall be held whole by a court of competent jurisdiction to be invalid, in whole or in part, the remaining terms and provisions shall survive and be binding on both parties.
17. If a winning bidder does not honor his or her bid with payment in full per the auction rules, then LPU auctions will contact the winning bidder. If the bidder is not able to pay the full amount then it is agreed that LPU Auctions may, at its sole discretion, extend an offer of the given item(s) in the lot(s) to the next highest bidder. The original winning bidder is responsible for any losses incurred or service charges involved in the sale of said item(s), and that the non-paying winning bidder explicitly agrees to pay any and all reasonable legal fees incurred by LPU in the collection of these losses and/or service charges from the non-paying winning bidder if necessary.
18. You acknowledge and agree that all decisions by LPU with respect to determining auction winners shall be final and binding.
19. You acknowledge and agree that neither LPU nor anyone else associated with an auction or an event for which items are auctioned shall be liable for any (A) Lost, late, misdirected or undelivered bids (B) Technical, network, electronic, computer, hardware, or software failures of any kind (C) Typographical errors in any web site, promotional copy or any policies (D) The completeness or accuracy of any information relating to teh auction or (E) Discrepancies between clocks or timing used by LPU to stop an auction or to order bids and any other clocks or timing, regardless of whether appearing on the website or through third party sources.
Guide for Prospective Bidders
Placing Bids in Internet Auctions
We strongly urge bidders to place initial bids early. Bids are welcomed and encouraged before the closing date of the auction. Most bidders choose to place their initial bids days before the closing dates. Please remember that if you have not bid on a lot before the day the item closes, you cannot bid on it. There are No Exceptions to this rule. Because of this rule, if you are the only bidder on a given item, then that auction is automatically closed out and you are declared the winner. If at closing time you are the high bidder on a given item, which has also received bids by other bidders, then you will be declared the winner.
Bid Notifications Via Email
You will receive bid confirmations and outbid notifications via e-mail on every lot you are bidding on, except when you are immediately outbid upon placing your bid due to an existing higher ceiling bid. In this case you will be notified on your computer screen. It has been noted that many Internet service providers (AOL in particular) and email programs will randomly identify these e-mails as spam and will delete them or delay delivery. As this is out of our control, we are unable to remedy this issue. As a result, we strongly recommend you track you bids as we cannot guarantee timely delivery of the notification e-mails through all ISPs.
Lot Ownership Disclosure
In the spirit of full disclosure, all lots are owned by LP Underground and LPU Auctions.
Auction Results
Full results of the auction will be available following the close of the auction on our website at Auction Results. Complete auction results of individual lots will be e-mailed to winning bidders.
